Terms of Service

1. Eligibility

You must be at least 13 years old (or 16 in the EEA/UK) to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Your Account

  • You are responsible for safeguarding your password and any actions taken under your account.
  • Notify us promptly at legal@grapevine.li if you suspect unauthorized access.
  • One person per account; do not share accounts or transfer them without our written consent.
  • We may suspend or terminate your account if we believe you have violated these Terms.

3. The Service

Grapevine provides text chat, voice and video calling, friend connections, a public forum, file uploads, a 3D virtual apartment system, optional paid subscriptions, and a developer/bot platform. Features may change, be added, or be removed at any time.

4. Acceptable Use

Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated by reference. Violating it may result in suspension or termination.

5. Your Content

Ownership. You retain ownership of the content you post on or through the Service ("Your Content"), including messages, uploads, forum posts, profile pictures, and 3D layouts.

License to us. You grant Grapevine a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, transmit, display, and adapt Your Content solely to operate, provide, and improve the Service (for example, to deliver a message you sent to its recipient, render a profile picture for your friends, or display a forum post on the website).

Responsibility. You are solely responsible for Your Content and represent that you have all rights necessary to grant the license above. We are not obligated to monitor content, but we may remove content that we reasonably believe violates these Terms, the Acceptable Use Policy, or applicable law.

6. Feedback

If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation.

7. Subscriptions, Payments, and Virtual Items

  • Paid features (e.g., "Wine" subscriptions) are billed through a third-party payment processor. By subscribing, you also agree to that processor's terms.
  • Subscriptions automatically renew at the then-current rate until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.
  • Except as required by law, payments are non-refundable.
  • In-app "coins", badges, and other virtual items have no monetary value, are non-transferable outside the Service, and cannot be redeemed for cash. We may modify or discontinue them at any time.

8. Intellectual Property

Grapevine, the Grapevine name and logo, the Service, and all related software, designs, and content (other than Your Content) are owned by Grapevine or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not reverse engineer, decompile, copy, modify, distribute, or create derivative works of the Service except as expressly permitted by law.

9. Third-Party Services

The Service may link to or interoperate with third-party services (such as payment processors, hosting providers, and developer integrations). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

10. DMCA / Copyright

If you believe content on the Service infringes your copyright, follow the procedure in our DMCA & Copyright Policy.

11. Termination

You may stop using the Service at any time and request account deletion by contacting legal@grapevine.li. We may suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms, if required by law, or if continued operation becomes impractical. Sections that by their nature should survive termination will survive (including ownership, license to feedback, disclaimers, limitations of liability, indemnification, and dispute terms).

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA OR CONTENT WILL BE ACCURATE OR PRESERVED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAPEVINE AND ITS OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Grapevine and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Oklahoma and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in the State of Oklahoma, and you consent to personal jurisdiction there. If you are a consumer in the EEA/UK, you may also bring proceedings in the courts of your country of residence to the extent required by applicable law.

16. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and Acceptable Use Policy, form the entire agreement between you and Grapevine concerning the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
